Recently, the German Federal Patent Court ruled on the patent infringement dispute between Nera Innovations and Xiaomi, revoking the ‘mobile terminal’ patent (EP2947606) asserted by Nera. With this ruling, all three patent infringement lawsuits brought by Nera against Xiaomi have now been dismissed at the first-instance stage.

On 9 June 2026, the Federal Patent Court held a hearing on the invalidity of patent EP2947606 and announced the revocation of the patent in open court. None of the alternative claims put forward by Nera were upheld. As the patent has expired, Nera can no longer seek an injunction based on this patent and may only claim damages for past infringements. Previously, the Düsseldorf Regional Court had stayed the corresponding infringement proceedings due to doubts regarding the validity of the patent.

Nera Innovations is a private equity-backed non-practising entity (NPE) that previously acquired three patents from LG Electronics and Giesecke & Devrient, and subsequently brought infringement proceedings against Xiaomi. Apart from EP2947606, which was the subject of this ruling, the first-instance outcomes for the other two patents are as follows:

EP2916418 (“Wireless charging and communication board and wireless charging and communication device”): Revoked by the German Federal Patent Court in February 2026 following the issuance of a negative preliminary opinion.

EP2642632 (“Wireless power receiver and method of manufacturing the same”): The granted version of this patent was revoked by the Hamburg Regional Court of the Unified Patent Court (UPC), and the amended version was also found not to infringe. Nera’s appeal regarding this patent before the Hamburg Regional Court of the UPC is scheduled for a hearing on 16 July 2026.

Consequently, Nera has failed in all three infringement cases against Xiaomi at the first-instance stage. If Nera is to achieve any substantive outcome, it must succeed in reinstating at least one of these patents on appeal.
