On July 30, 2026, following the issuance of a non-binding preliminary opinion by the German Federal Patent Court, the Seventh Civil Division of the Munich Regional Court No. 1 decided to cancel the trial on the very day it was scheduled to begin in the case of Advanced Standard Communication (ASC) v. Xiaomi regarding infringement of standard-essential patents.

The dispute began in 2024 when ASC filed a lawsuit with the Munich Regional Division of the Unified Patent Court (UPC), alleging that multiple Xiaomi products infringed on its European patents. Subsequently, Xiaomi filed invalidity challenges against five Chinese patents held by ASC; four of these were invalidated in their entirety, while one retained only a single valid claim. On the European front, on May 19, 2026, the UPC Court of Appeal issued a ruling rejecting ASC’s request for a discretionary review and a stay of execution.

Following the cancellation of the hearing at the Munich First Regional Court, the next hearing in the UPC case may be postponed until December 2026. IP Finance will continue to monitor further developments.

Case Background

In May 2025, Xiaomi filed a counterclaim for revocation of the European patent at issue at the UPC Munich Regional Division;

On October 6, 2025, the UPC Munich Regional Division dismissed ASC’s claims of infringement of 5G standard-essential patents, which had been added during the proceedings;

In November 2025, ASC filed a new patent infringement lawsuit against Xiaomi at the UPC Munich Regional Division;

From November to December 2025, in response to invalidation challenges filed by Xiaomi, the China National Intellectual Property Administration issued examination decisions on five Chinese patents held by ASC;

In March 2026, the UPC Munich Regional Division required ASC to provide security for litigation costs within eight weeks of service;

On May 19, 2026, the UPC Court of Appeal dismissed ASC’s request for a discretionary review and a stay of execution;

On July 30, 2026, the 7th Civil Division of the Munich Regional Court was scheduled to hear the case of ASC v. Xiaomi.
