Recently, the patent portfolio management company Malikie Innovations Limited filed a lawsuit against OPPO, its sub-brands Realme and OnePlus, and OPPO’s distributors in Europe regarding Patent No. EP3843496.

Case information updated by the Mannheim Regional Division of the UPC on July 27, 2026, shows that the lawsuit was officially accepted on July 9. Previously, on February 2, 2026, Malikie filed a lawsuit against OPPO at the Mannheim Regional Division of the UPC regarding patent EP2387862B1; On March 4 of the same year, Malikie filed an additional lawsuit at the UPC’s Mannheim Regional Division. The patents involved in the two previous cases—EP2387862 and EP3797535—are the same as those Malikie used in its November 2025 lawsuit against Xiaomi.

Founded in 2023, Malikie is a patent operating entity under the Irish company Key Patent Innovations. In May 2023, the company acquired 32,000 patents from BlackBerry for $200 million, covering technical fields such as wireless communications and data transmission; in January 2024, it also obtained the exclusive right to sublicense more than 2,000 of BlackBerry’s cellular standard-essential patents (SEPs).

Malikie has been in negotiations with Xiaomi and OPPO since 2023, but progress has been slow. On March 2, 2026, Xiaomi filed a lawsuit with the Shenzhen Intermediate People’s Court seeking a determination of FRAND rates against Malikie, requesting confirmation of Malikie’s obligation to grant licenses under FRAND terms and to negotiate in good faith, as well as the determination of FRAND rates for 3G, 4G, and 5G SEPs within China.

Case Background

In July 2025, Malikie filed lawsuits against Xiaomi in the Munich Regional Court in Germany and the Delhi High Court in India;

In November 2025, Malikie filed an additional lawsuit against Xiaomi at the Munich Division of the Unified Patent Court (UPC);

On February 2, 2026, Malikie filed its first lawsuit against OPPO at the Mannheim Regional Division of the UPC;

On March 2, 2026, Xiaomi filed a lawsuit with the Shenzhen Intermediate People’s Court seeking the determination of FRAND rates against Malikie;

On March 4, 2026, Malikie filed a second lawsuit against OPPO at the Munich Division of the UPC;

On April 30, 2026, the Delhi High Court in India issued a ruling in the Malikie v. Xiaomi SEP dispute, requiring Xiaomi to provide a provisional security deposit;

On July 9, 2026, Malikie filed a third patent infringement lawsuit against OPPO, its sub-brands Realme and OnePlus, and OPPO’s distributors in Europe at the UPC Mannheim Regional Division.
