On August 10, 2026, the Hamburg Regional Division of the Unified Patent Court (UPC) granted the application filed by the German company Cybex and issued a preliminary injunction ordering the Dutch company NUNA International B.V. and its affiliate Allison GmbH to cease sales of the relevant child safety seat combination products in all 18 member states.

The patent at issue is EP4242056, owned by Cybex. The court found that NUNA’s “base curv” base, when combined with multiple seat components, infringed the claims of this patent. Applying the “preponderance of the evidence” standard, the court determined that the accused products fell directly within the scope of protection; furthermore, since they were specifically designed to be assembled into the patented system, the separate sale of the base or seat components also constituted indirect infringement.

Regarding the necessity of the injunction, the court noted that child car seats are durable consumer goods; once customers purchase NUNA products, a “lock-in effect” is created, preventing them from becoming Cybex customers for several years. Requiring Cybex to wait for the main proceedings would be unfair to the company. Furthermore, the harm NUNA would suffer from the injunction does not exceed the usual scope, and since the court only prohibited the sale of the combination—rather than imposing an absolute ban on individual components—the interests of both parties have been balanced. Cybex filed its application within one month of the patent grant, and there was no undue delay.

It is worth noting that the parties to this case—Cybex of Germany and NUNA of the Netherlands—have been acquired by China’s Kunshan Goodbaby Group and Taiwan’s Mingmen Group, respectively. Previously, in 2024, Mingmen Group sued Cybex for infringement involving baby strollers, but the first-instance court did not uphold its claim, and the case is currently under appeal; Cybex, meanwhile, filed a revocation action with the Paris Division of the UPC in April 2026 and initiated a new infringement action with the Düsseldorf Division of the UPC in June.

Case Background

On December 20, 2024, Mingmen Group filed a lawsuit against Cybex with the Düsseldorf Regional Division of the UPC, alleging that several of its strollers infringed Patent No. EP1905615;

On April 13, 2026, Cybex filed a revocation action with the UPC Paris Division;

On April 20, 2026, Cybex applied for a preliminary injunction with the UPC Hamburg Division, alleging that NUNA infringed Patent No. EP4242056;

On May 27, 2026, the Düsseldorf Regional Division of the UPC issued a first-instance decision finding that Cybex had not infringed the patent;

On June 18, 2026, Cybex filed a lawsuit against NUNA, JOIE, and other companies with the UPC Regional Division in Düsseldorf, alleging infringement of Patent EP3564068;

On August 10, 2026, the UPC Regional Division in Hamburg issued a ruling on Cybex’s application for a preliminary injunction, ordering NUNA to cease infringement in all 18 member states of the UPC.
