Onesta IP LLC has filed a lawsuit against BMW AG in Munich's First Regional Court, alleging infringement of three semiconductor patents—one European patent and two U.S. patents.

Onesta IP LLC is an NPE (non-practicing entity) based in Wayne, Pennsylvania, USA. The company primarily focuses on enforcing its rights through intellectual property litigation, with particularly active litigation in the semiconductor sector.

This case marks the first known infringement lawsuit involving U.S. patents to be heard by a German regional court following the BSH Hausgeräte v. Electrolux ruling.

In February 2025, the European Court of Justice delivered a landmark ruling in BSH Hausgeräte v. Electrolux, declaring that national courts do not lose jurisdiction to assess foreign patent infringement (based on the defendant's domicile) merely because the defendant challenges the patent's validity.

On October 28, the Munich Regional Court published its reasoning for granting Bayer, a partner of Regeneron, a preliminary injunction against Formycon's biosimilar, which carries long-arm effect applicable to nearly twenty countries.
