Optis has recently filed a patent infringement lawsuit against OPPO in the Delhi High Court. Optis is asserting five standard-essential patents covering 2G, 3G, 4G (LTE), and 5G technologies. The case is being heard by Justice Tejas Karia.

Previously, OPPO has been involved in multiple patent lawsuits in India:

(1) Dolby Laboratories

November 2016: Dolby Laboratories sued OPPO and its sister brand vivo in the Delhi High Court, alleging that mobile phones sold by both companies in India infringed upon its essential patents for audio compression standards and had long defaulted on patent royalties. The court accepted a proposal requiring “a security deposit of 34 rupees per device,” allowing OPPO phones to continue sales. After three years of legal wrangling, the parties reached a settlement in 2018. OPPO paid back fees at a “reasonable rate,” concluding the case.

(2) InterDigital

In December 2021, InterDigital (IDC) filed an SEP lawsuit against OPPO in Indian courts, involving five patents covering 3G, 4G, and 5G standards. OPPO subsequently filed a counterclaim, requesting the court to determine the FRAND rate for IDC's global patent portfolio.

In early 2023, the Delhi High Court issued a significant order requiring OPPO, OnePlus, and Realme to deposit funds with the court within three months as security for their sales of devices utilizing InterDigital patents in India from 2021 to 2024.

On October 29, 2024, OPPO and InterDigital announced the signing of a global patent licensing agreement covering InterDigital's cellular network, HEVC video, and WiFi patents. Under the agreement, both parties resolved all pending litigation in all global jurisdictions, including cases in India.

(III) Nokia

In July 2021, Nokia initiated patent litigation against OPPO in India.

In July 2023, the Delhi High Court in India ruled that OPPO must pay a provisional security deposit equivalent to 23% of the original license agreement amount within four weeks, reflecting its sales share in India.

On the afternoon of January 24, 2024, OPPO announced the signing of a global patent cross-licensing agreement with Nokia, declaring a settlement. The agreement covers both parties' standard-essential patents in 5G and other cellular communication technologies.
