Sol IP recently filed patent lawsuits against Chinese automaker BYD in Mannheim Regional Court (Case No. 14 O 31/25) and UPC’s The Hague Local Division (LD) (Case No. 25253/2025). The patents involved are EP2720392 ("Control information transmission and reception method for mobile communication system") and EP2127188 ("Downlink frame generation method and cell search method"), both of which were originally held by the Electronics and Telecommunications Research Institute (ETRI) of Korea.

In the UPC case, Sol IP filed a request for an injunction covering multiple UPC member states and non-member Spain. Its claim is based on the rules established by the European Court of Justice in the "BSH Hausgeräte v. Electrolux" case, and attempts to extend jurisdiction to the Spanish market through BYD's Dutch subsidiary as an "anchor defendant". Previously, patent holders such as IP Bridge have also filed similar lawsuits against BYD in Munich, Germany and other places.

According to the UPC procedural rules, the plaintiff must make all claims at the beginning of the lawsuit and cannot add them later. This provision forced Lenovo to initiate new litigation in a similar case because it failed to apply for an injunction in a timely manner. The UPC target review period is one year, which means BYD may need to deal with the potential risk of multiple injunctions before 2026.
