Recently, Voxer filed a lawsuit against Amazon and its subsidiaries in the United States District Court for the District of Delaware, accusing them of infringing five patents involving similar video communication technologies and seeking both damages and a permanent injunction.

Founded in 2007, Voxer is a mobile application developer headquartered in Dallas, best known for its free communication app for smartphones called “Walkie-Talkie.” In January 2020, Voxer sued Meta (formerly Facebook) in the United States District Court for the Western District of Texas, alleging that certain features of Facebook and Instagram Live infringed two of Voxer's patents related to “Live Messaging” and “Store-and-Stream” technologies. In July 2023, the court ruled in favor of Voxer, awarding it $206 million in damages and ongoing royalties. Meta subsequently appealed, but the two parties reached a settlement within six months.

Among the five patents asserted by Voxer in this case, two were previously asserted in the lawsuit against Meta. Voxer pointed out that Meta had filed inter partes review (IPR) requests with the United States Patent and Trademark Office (USPTO) regarding these two patents, but none were instituted. Meta then attempted ex parte reexamination, yet the USPTO still maintained the validity of the patents. Voxer argued that this fully demonstrated that the two patents covered patentable subject matter and were not directed to abstract concepts or any non-patentable subject matter. Furthermore, Voxer contended that although the remaining three patents were not asserted in the lawsuit against Meta, the USPTO's maintenance of the original claims of the first two patents during Meta's ex parte reexamination also corroborated the patentability of the latter three patents.

Previously, Amazon had been involved in several other patent infringement disputes in the United States District Court for the Western District of Texas, including lawsuits with Xockets and AlmondNet. Amazon has also reached settlements in some cases, such as with Nokia this year, and with Adeia and Huawei last year.
